1. GP FOR ENERGY (AP) The Court made the following ORDER:
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Energy for the respondents. 2. The above contempt case is filed complaining violation of the common order dated 06.04.2014 in W.P.No.9988 of 2014 and batch. 3. The petitioners, working as Shift Operators on contract basis, filed the above writ petition. The said writ petition was disposed of on 16.04.2014. The operative portion of the order is as follows:

“In the light of the submissions made by the respective parties in these three writ petitions, this Court deems it appropriate to dispose of all the three writ petitions without spelling out anything on the merits, but with a direction to the respondent authorities, especially, respondents 1 and 2 to consider the report dated 25.11.2011 submitted by the 3rd respondent and take appropriate decision thereon, as expeditiously as possible, at any rate, within a period of twelve (12) weeks from the date of receipt of a copy of the order. There shall be no order as to costs.”
4. In the affidavit filed in support of the contempt case, it was pleaded that despite the petitioners’ request to implement the order of the Court, the same was not complied with. 5. A counter-affidavit was filed by the 1st respondent. In the counter- affidavit, a speaking order vide Memo No.1875/OP/A3/2014-3, dated 20.04.2015 was filed. The operative portion of the speaking order dated 20.04.2015 is as under:
“Therefore following the law laid down by Hon’ble Supreme Court, and the orders of Govt. of United A.P vide G.o.ms.No.46 Labour, dt.20.06.2008, keeping the G.O.Ms.5, Labour, dated 24.01.2001 in abeyance and considering the reports of Electricity utilities and considering the stand already taken by the Govt. of United A.P.State Govt.
of A.P hereby decided not to act upon the said report since it find no merit, and holds that there is no merit in the claims of petitioners to appoint them as regular employees of utilities or to pay the same salary as is paid to regular employees of who are doing same kind of work.”

Though learned counsel for the petitioners would submit that the order was not passed within the time stipulated, since a speaking order dated 20.04.2015 was passed by the 1st respondent, however, with some delay, in considered opinion of this Court, the order dated 16.04.2014 has been complied with. 3
7. Therefore, the Contempt Case is closed. However, this order will not preclude the petitioners from challenging the speaking order if the petitioners’ are aggrieved. No order as to costs.
