The petitioner has been made accused in connection with Chaibasa Muffasil P.S. Case No. 86 of 2024, corresponding to Spl. POCSO Case No.29 of 2024, for the offences registered under Section 376AB of the I.P.C. and Sections 4 and 6 of the POCSO Act. Thereafter charge has been framed under Section 376AB of the I.P.C. and Section 6 of the POCSO Act, pending in the Court of learned Spl. Judge, POCSO Act, West Singhbhum at Chaibasa. On 03.06.2024, petitioner who is aged about 62 years is alleged to have enticed seven years daughter of the informant to accompany him and took her to an isolated place and put his fingers in her private part. Learned counsel for the petitioner submitted that statement of the victim has been recorded during trial in which she has not supported the prosecution case and as such, she has been declared hostile. She has further stated that no occurrence has taken place. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. Learned trial court shall dispose of the trial as expeditiously as possible. (Ambuj Nath, J.) Jay/-
