Heard the parties.
Learned counsel for the petitioner submits that this Cr.M.P. has been filed for release of the seized vehicle bearing Registration No. JH 01 CR 8980 which was rejected by the learned SDJM, Ranchi in connection with Doranda P.S. Case No.116 of 2018 corresponding to G.R. Case No.3177 of 2018 as the owner of the vehicle who hypothecated the vehicle to the petitioner- Bank, objected the same as well as the State also objected the same. It is next submitted that in this case by filing a counter-affidavit, the opposite party No.2- owner of the vehicle has filed an affidavit to the effect that the vehicle be released in favour of the Bank and in view of the new development, the learned counsel for the petitioner submits that the petitioner seeks permission of this court to withdraw this Criminal Miscellaneous Petition with liberty to approach the trial court afresh in view of the consent of the opposite party No.2 for release of the vehicle in favour of the Bank.
Considering the aforesaid facts, permission is accorded.
Accordingly, this Criminal Miscellaneous Petition is dismissed as withdrawn with the aforesaid liberty.
