This Writ Petition (Cr.) under Article 226 of the Constitution of India has been filed with a prayer for issuance of an appropriate writ(s)/order(s)/ direction(s) to the learned Sessions Judge, Gumla for expedite the trial of Ghaghra P.S. Case No.150 of 2020, corresponding to G.R. No.49 of 2021 offence punishable under Section 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the said case was instituted in connection with murder of the one of the sons of the informant namely Nitesh Baraik. It is next submitted that so far, two witnesses including the petitioner have been examined in the sessions trial and the petitioner undertakes to produce his other son namely Hari Dayal Baraik, on the next date of listing of this case i.e. on 07.02.2025 and on the subsequent dates to be

fixed by the learned Sessions Judge, Gumla, and he will also produce the other two witnesses cited in the charge sheet namely Sarita Devi and Harihar Singh. Hence, it is submitted that the learned Sessions Judge, Gumla be directed to conduct the expeditious trial of the case.

Learned counsel appearing for the State submits that State will ensure that after the rest three private witnesses whose names have been cited in the charge sheet as witnesses are examined, the State will also ensure that the IO of the case appears before the trial court and his evidence is recorded.

Learned counsel for the petitioner submits that the IO of the case Bullet Gorai, has been now posted in Pundag(O.P.) under Jagannathpur Police Station and the State will ensure that he will be examined as witness.

Considering the fact that the sessions trial is going on since the year 2021, this writ petition is disposed of with a direction to the learned Sessions Judge, Gumla or its successor court to ensure speedy trial of the sessions case corresponding to Ghaghra P.S. Case No.150 of 2020 and to record the evidence of the three witnesses cited in the charge sheet on the next date fixed for recording evidence or subsequent dates to be fixed by him and to ensure that the sessions trial is concluded preferably within a period of three months from the date of receipt of this order by the said Court.
7. This W.P. (Cr.), stands disposed of accordingly.
