2025:JHHC:16707 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.7775 of 2024 ------ Naresh Kumar @ Naresh Soni, son of Sri Mahendra Soni @ Mahendra Swarnkar, resident of village Chnadwara Purwi, PO and PS Chandwara, District Koderma … … Petitioner(s) Versus The State of Jharkhand. … … Opposite Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Manoj Kumar, Advocate. For the State : Mr. Vijoy Kr. Sinha, A.P.P. ----- 04/ 24.06.2025 Heard the parties. 2. This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 127(2), 118(1), 123, 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 pending in the court of learned Judicial Magistrate 1st Class, Koderma in connection with Chandwara PS Case No. 61 of 2024. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. Learned counsel for the petitioner submits that in the restatement of the victim he has stated that the petitioner has not committed unnatural offence. 5. I have gone through the FIR. As per the FIR it is alleged that the petitioner and others have committed unnatural offence. In the FIR the victim has specifically stated about the act which Naresh Kumar i.e. the petitioner has done with the informant, which is definitely an unnatural offence. Restatement of the informant clearly suggests that he has been influenced by this petitioner, as the victim exonerates the petitioner. This gives an impression that the petitioner is tampering the witnesses. 6. Thus, this is not only a case of custodial interrogation but also a case of custodial trial. 7. Accordingly, this Anticipatory Bail Application stands dismissed. (ANANDA SEN, J.) Tanuj/Cp-3
