P.P. --------- 03/06.01.2025 Heard Mr. Jay Shankar Tiwary, learned counsel for the petitioner and Mr. Vineet Kr. Vashishtha, learned Spl. P.P. for the opposite party. The petitioner is an accused in connection with A.C.B. P.S. Case No. 12 of 2024. It has been alleged by the complainant that a false case was instituted against him by the Forest Range Officer, Barhi vide Case No. 63 of 2024 and when he had approached the concerned Forest Range Officer a demand of 50,000/- was made for removal for his name and Rs. 25,000/- for getting reduction in the fine amount. On a complaint made the same was verified and found to be true and thereafter a trap was laid on 27.09.2024 in which the petitioner was caught red handed with the tainted money. Submission has been advanced by the learned counsel for the petitioner that the main allegation is against the Forest Range Officer, Barhi namely, Amar Anand Sarswati. It has further been submitted that so far as the petitioner is concerned, he is merely a daily wager and does not have any concern with the said act. It has also been submitted that the A.C.B. has submitted charge-sheet against the petitioner. Learned counsel adds that the petitioner is in custody since 27.09.2024. Learned Spl. P.P. has opposed the prayer for bail of the petitioner. Regard being had to the period of custody undergone by the petitioner and the fact that charge-sheet has already been submitted by the A.C.B., the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Special Judge, ACB, Hazaribagh in connection with A.C.B.
