Petitioner/Accused No.1 &2 AND The State of Andhra Pradesh, Rep. by its Public Prosecutor, High Court of Judicature of Andhra Pradesh at Amaravati. Respondent/Complainant Petition under sections 480 & 483 of BNSS (Old Sections 437 & 439 of Cr.P.C), praying that in the circumstances stated in the affidavit fl-led in support of the Criminal Petition, the High Court may be pleased to release the Petitioners/Accused. The petition coming on for hearing, upon perusing the petition and the grounds filed in support thereof and upon hearing the arguments of sri BALABHADRUNI MANOHAR, Advocate for the Petitioners and of PUBLIC PROSECUTOR for the Respondent and the court made the following;
J~j,` ORDER: ® This Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seekl-ng to enlarge the petitioners-accused Nos. 1 and 2 on bail in crime No. 76 of 2025 of Makavarapalem Police Station, Anakapalli District, registered for the offence punishable under Sections 20 (b) (ii) (C) and 25 read with Section 8 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution is^that on 18-06-2025 at 9.30 hours at Pydipala Junction, Makavarapalem Mandal, the Sub Inspector of Police along with his staff and mediators, while conducting vehicle checking, found accused Nos, 1 and 2 in possession one K.G. of liquid Ganja. Thereafter, the police seized the contraband, arrested accused Nos. 1 and 2 and remanded them to judicial custody. 3. Sri Balabhadruni Manohar, learned counsel forthe petitioners, contends that the petitioners are innocents of the alleged offence and have b;en falsely implicated by the police. It is further submitted that the petitioners are the sole earning members of their family and, therefore, their continued incarceration would cause undue hardship to their dependents.
The petitioners undertake to strictly adhere to any conditions that may be imposed by this court. In light of the foregoing, learned counsel prays that the present petition be allowed in the interest of justl|ce. t---. '+i_E= 4, Per confra, Ms. Akhila Naidu, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petit.ioners, submitting that the investigation is still undervay and several material witnesses remain to be examined. It is contended that if the petitioners are released on bail at this stage, there is a strong likelihood that they may abscond, thereby hampering the ongoing investigation and evading the process of law. ln view of the foregoing, it is urged that the petition be dismissed. 5. Heard learned counsel for the petitioners and learned Assistant Public I Prosecutor. Perused the record. 6. As seen from the record, the petitioners-accused Nos. 1 and 2 were allegedly dealing with one K.G. of liquid Ganja which is non-commercial quantity. The petitioners were arrested on 18-06-2025 and they have been in judicial custody for the past 65 days. All the witnesses in this case are official witnesses. Prime witnesses have been examined. Therefore, Question of the petitioners threatening the witnesses or interfering with the investigation Process Or hampering the evidence may not arise. 7. Considering the facts and circumstances of the case and the nature and gravity of the allegations levelled against the petitioners-accused Nos. 1 and 2, this Court is inclined to enlarge +|he petitioners-accused Nos. 1 and 2 on bail with the following stringent conditions: (i) The petitioners-accused Nos.1 and 2 shall be enlarged on bail subject to their executing each a bond for a sum of Rs.25,000/- `,`- 'J= vi

1 and 2 shall appear before the Station House Officer concerned on every Saturday.in between 10 a.m. and 5 p.m. till cognizance is taken by the learned the Trial Court; .(iii) The petitioners-accused Nos. 1 and 2 shall not leave the limits of the district without prior permissl'on from the investigating officer; (iv) The petitioners-accused Nos.1 and 2 shall'not commit or indulge in commission of any offence in future; (v) The petitioners-accused Nos. 1 and 2 shall coope.rate with the investigating officer in further investigation of the case and shall make themselves available for interrogation by the investigating offI'Cer aS and When required; (vi) The petitioners-accused Nos. 1 and 2 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from dl'sclosing such facts to the court or to any police officer; and TedPZir3giv _--Z*
