Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material brought on record. 3. Learned counsel for the applicant submits that the F.I.R. was lodged by police personnel with the allegation that initially one Simran filed a complaint case bearing No. 37/24 under Sections 376D/506 I.P.C. and Section 5G/6 of POCSO Act before the court concerned against Om Prakash Kushwaha @ Satish, Jitendra Sharma, Uma Shankar Yadav, Raja Sahab Bhadauria, Ravi Prakash Jha and others alleging therein that on the pretext of providing her a job in railway department the accused persons named in the complaint had committed her rape several times. Learned counsel further submits that applicant is not named in the F.I.R. and his name came into light in the confessional statement of co-accused persons. There is no credible evidence against the applicant and he has been implicated in the case only being a nephew of one co-accused Naveen Vishwakarma. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him.
