1 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(S) No.5876 of 2022 ------ Ram Pyare Ram, son of Surendra Ram, resident of Village Khajuri, Lakueyi, P.O. Ataula, P.S. Manjhigaon, District Gadwa, Jharkhand. … … Petitioner Versus 1. The State of Jharkhand, through Director General of Police, Government of Jharkhand, at Police Head Quarter, Near Project Building, P.O. Dhurwa, P.S. Jagannathpur, District Ranchi. 2. The Deputy Inspector General of Police, Palamu. 3. The Superintendent of Police, Latehar. … … Respondents ------ CORAM : SRI ANANDA SEN, J ------ For the Petitioner(s) : Mr. Ajay Kr. Pathak, Advocate For the Respondent(s): Mr. Suraj Prakash, AC to SC-VII ------ 06/ 12.02.2025 Admittedly, the petitioner has not preferred an Appeal against his dismissal from service. The Appeal admittedly now is time barred. 2. The fact which cannot be lost sight of is that the petitioner stood acquitted in the criminal proceeding. 3. Since the criminal proceeding ended in acquittal of the petitioner, it is necessary to decide the effect of the criminal case, the departmental charge, the facts related to the said charge and the misconduct and that can be best appreciated by the Appellate Authority. 4. Thus, I direct the petitioner to file an Appeal bringing to the notice of the Appellate Authority about the acquittal and the order passed by the Trial Court. Once the Appeal is filed along with all the documents, the Appellate Authority will consider the same including the effect of the acquittal and will pass an appropriate order on the Appeal filed by the petitioner, on merits, without dismissing 2 the appeal on the ground of limitation. 5. The Appeal should be disposed of within a period of eight weeks from the date of receipt of copy of this order. 6. With the aforesaid observation, this writ petition stands disposed of.
