CORAM :
SRI ANANDA SEN, J. ------ For the petitioner(s): Mr. A.N. Deo, Advocate. For the State Mr. Aditya Raman, AC to GA-III For Resp Nos. 4 to 34: Mr. Awanish Ranjan Mishra, and Ujjwal Jaipuriar, Advocates. ------- 09/28.04.2025: Heard the learned counsel for the parties.
2. It is alleged that inspite of making complaint to the police officials by
the petitioner, they are not registering the FIR.
3.
Learned counsel for the petitioner submits that the petitioner has also approached to the Superintendent of Police, Hazaribagh, but the respondent authority has not registered the FIR. He also submits that if a cognizable offence is made out and reported to the police, the same needs to be registered. He further adds that the Police Officer cannot deny to register the FIR.
4. The fact also which needs to be noted is that if an FIR is not being registered, there is statutory remedy in BNSS. The petitioner has not availed the said remedy, rather has approached this Court by filing with criminal writ under Article 226 of the Constitution.
5. Since there is alternative remedy, available to the petitioner, I am not inclined to entertain this writ petition. Accordingly this writ petition is disposed of with liberty to the petitioner to approach the appropriate Court by filing an application seeking relief(s) under BNSS.
