(At Present In Sub Jail, Khetri). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Vijayant Nirwan, Adv. For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 08/09/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.62/2024, registered at Police Station Pacherikalan, District Jhunjhunu, for the offence(s) under Section 302 of IPC.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated under Sections 302 and 120-B of IPC. It is contended that the main allegation of causing the murder of deceased Bhanaram is attributed to the co-accused Maan Singh and Amit Kumar. The allegation against the petitioner is that he along with co-accused Man Singh, Manju Devi, and Amit Kumar have conspired and thereafter caused the murder of the deceased Bhanaram. It is further submitted that, apart from the disclosure statements of the other co-accused, no substantive
[2025:RJ-JP:35811] (2 of 3) [CRLMB-11259/2025] evidence is available on record to establish the petitioner’s involvement in the alleged crime. It is further contended that no incriminating material was recovered from the petitioner’s possession and as per the charge-sheet submitted on 31.03.2024, co-accused Man Singh and Amit Kumar caused the murder of deceased Bhanaram by firing at his temple region. It is argued that the accused-petitioner is in custody since 11.04.2024 and the main co-accused, Man Singh and Manju Devi, have already been enlarged on bail by this Court and the trial of the case may take considerable time, therefore, the bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. 4. Heard and perused the material available on the record. 5. As per the charge-sheet, the main allegations considering the murder of deceased Bhanaram are against co-accused Man Singh and Amit Kumar. It is noted that co-accused Man Singh has already been enlarged on bail by this Court. Therefore, considering the submissions advanced by learned counsel for the petitioner and upon perusal of the allegations mentioned in the charge-sheet and without expressing any opinion on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused petitioner- Jitendra @ Vijendra S/o Triveni Prasad, in connection with FIR No.62/2024, registered at Police Station Pacherikalan, District Jhunjhunu, shall be enlarged on bail provided he furnishes a
