This is the first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sahita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 855 of 2024 registered at Police Station Tikrapara District- Raipur (C.G.), for the offence punishable under Section 18 (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution, in brief, is that the police Officials of the 2 concerned Police Station received anonymous tip from their informer that some persons are having 3.904 Kg of opium, the police Officials when reached on the spot arrested the co-accused person namely- Mohammed Jasid Meer and the present applicant who is aged about 65 years, The police has recorded the memorandum statement of co- accused Mohammed Jasid Meer, who stated that he has purchased the Opium from one Mahesh Sahu who is also a co-accused in this case. Therefore, the aforesaid offence has been registered against the accused persons. Hence this bail application. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case. He would also submit that the applicant is an old person aged about 65 years and he has no connection with the present case as he was not in possession of any bottles of cough syrup. He would further submit that the applicant has no previous criminal antecedent. Therefore, he prays that the present applicant is entitled for grant of regular bail. 4. On the other hand, the learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. He further submits that the bail application bearing MCRC No. 3466 of 2025 of the co-accused person namely- Mahesh Sahu was rejected by this Court on 05.05.2025 and as such, the applicant is also not entitled to be released on bail 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, nature and 3 gravity of offence levelled against the applicant and the fact that in the present case, charge-sheet has been filed before the competent Court and the quantity of contraband article which was recovered, is more than commercial quantity and also considering the fact that vide order dated 05.05.2025, in MCRC No. 3466 of 2025, the bail application of the co-accused person is rejected, therefore, I am not inclined to grant bail to the present applicant. 7. Accordingly, the bail application of the applicant – Jaswant Singh involved in Crime No. 855 of 2024 registered at Police Station Tikrapara District- Raipur (C.G.), for the offence punishable under Section 18 (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
