ORAL ORDER
Accused in S.C.No.10024/2024 pending before the Court of Principal District & Sessions Judge, Doddaballapura, Bengaluru Rural District arising out of Crime No.174/2023 registered by Doddabelavangala Police Station, Bengaluru Rural District for the offence punishable under Section 302 R/w 34 of IPC is before this Court under Section 439 of Cr.P.C, seeking regular bail. 2. Heard the learned counsel appearing for the parties. 3. FIR in Crime No.174/2023 was registered by Doddabelavangala Police Station, Bengaluru Rural District initially for the offence punishable Under Section 302 of IPC against the petitioner herein and another, on the basis of first information dated 23.10.2023 received from Smt. Jayamma W/o Late Rudrappa. During the course of investigation, the petitioner herein who was arraigned as accused No.1 in FIR was arrested on 10.11.2023 and

subsequently remanded to judicial custody. Investigation in the case is complete and charge sheet has been filed against three persons and the petitioner is arraigned as accused No.1 in the charge sheet. 4. The bail application filed by the petitioner before the jurisdiction Sessions Court in Crl.Misc.No.10226/2023 was dismissed on 02.02.2024. Therefore, he is before this Court. 5. Perusal of the material on record would go to show that, the petitioner is the younger brother of the deceased Gangaraju. Accused No.3 is the wife of Gangaraju. In the charge sheet it is alleged that accused Nos.1 and 3 had illicit relationship and therefore they had conspired with accused No.2 to commit the murder of Gangaraju. In furtherance of such conspiracy, on 13.10.2023, accused Nos.1 to 3 had entered the house of Gangaraju and after quarreling with him allegedly had committed his murder by dropping grinding stone on his head. - 4 -

6. In the charge sheet the allegation of dropping grinding stone on the head of the deceased is as against accused No.1. The allegation against accused Nos.2 and 3 is that they had caught hold of Gangaraju. The entire case of the prosecution is based on circumstantial evidence. Undisputedly, the petitioner has no other criminal antecedents. Accused Nos.2 and 3 have been granted regular bail in Crl.P.No.3598/2025 and Crl.P.No.7977/2025 respectively.
Under these circumstances, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. 7. Accordingly, the following:
ORDER Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.10024/2024 pending before the Court of Principal District & Sessions Judge, Doddaballapura, Bengaluru Rural District arising out of Crime No.174/2023 registered

by Doddabelavangala Police Station, Bengaluru Rural District for the offence punishable under Section 302 R/w 34 of IPC, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future;
