The instant writ application has been preferred by the petitioner for the following reliefs:
“1. for issuance of an appropriate Writ/ Order/ Direction commanding upon the concerned Respondents to fix the correct pay and allowance after removing of anomalies in the pay scale of petitioner and make payment of salary with grade pay of Rs.5,400/= of District Commandant as he worked on the post and for grant of all consequential benefits; And/or Any other appropriate writ/order/direction as Your Lordships may appear fit and proper for doing conscionable justice to the petitioner.”

Learned counsel for the petitioner submits that the petitioner had filed a representation on 22.06.2015 before the respondent-authority but nothing has been communicated to him. As such, learned counsel submits that respondents may be directed to decide the representation of the petitioner.

Learned counsel for the respondents submits that though a counter affidavit has been filed; however, no decision has yet been taken with regard to the representation filed by the petitioner earlier. He submits that the instant writ application may be disposed of by directing the petitioner to approach the respondent no.4 to look into his grievance.

Having regard to the aforesaid facts and circumstances of the case and the submissions made by the rival parties; the instant writ application is disposed of by directing the petitioner to approach the 4th Respondent by filing a fresh representation with regard to the claim made in the instant writ application. The 4th Respondent shall take a decision in the matter with regard to claim of the petitioner by passing a reasoned and speaking
order. The entire exercise shall be completed within a period of twelve weeks from the date of receipt/production of copy of this order.
