02. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. On being prayed, the names of Mr. Surya Narayan Mishra and Mr. U.K. Mallick, learned counsels stand deleted from the cause list as well as the brief. Mr. Akshaya Kumar Sahoo, learned counsel for the petitioners by filing a memo, which is taken on record, prays to not press the bail application of petitioner Nos.2 and 3 namely Benu @ Satyaban Maharana and Yudhisthira Maharana respectively. Accordingly, the bail application of the petitioner No.2 Benu @ Satyaban Maharana and petitioner No.3- Yudhisthira Maharana stands disposed of as not pressed and the present bail application is only confined to petitioner No.1-Jayanta Das. 3. This is a bail application U/S.483 of BNSS by the petitioner No.1-Jayanta Das for grant of bail in connection with Chandanpur PS Case No.268 of 2024
corresponding to GR Case No.742 of 2024 pending in the file of learned NGN, Puri, for commission of offences punishable U/Ss.333/ 296/ 118(1)/ 118(2)/ 303(2)/ 76/ 109/ 351(2)/ 3(5) of BNS, on the main allegation of assaulting the injured Smruti Ranjan Paital and Bishnupriya Paital by means of lethal weapons, along with co-accused persons. 4. Heard, Mr. Akshaya Kumar Sahoo, learned counsel for the petitioner No.1-Jayanta Das; Mr. Prasanta Kumar Tripathy, learned counsel for the informant and Mr. R.B. Mishra, learned Additional Public Prosecutor in the present matter and perused the record. 5. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner No.1- Jayanta Das vis-à-vis the accusations sought to be brought against him and regard being had to the pre- trial detention of the petitioner No.1-Jayanta Das in custody since 25.03.2025 with submission of charge- sheet in the meantime and taking into account the main allegation of assaulting the injured by means of sharp cutting weapon being directed against co-accused Benu @ Satyaban Maharana and Manas @ Yudhisthira Maharana, whose bail application has been not pressed and taking into account the other circumstances on record in entirety including the right of the accused to be presumed innocent until proven guilty, this Court
notwithstanding with the serious objection as raised by Mr. Tripathy considers it proper to admit the petitioner No.1-Jayanta Das to bail. 6.
Hence, the bail application of the petitioner No.1-Jayanta Das stands allowed and the petitioner No.1-Jayanta Das is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:-
(i) the petitioner shall not contact or threaten the informant and his family members till disposal of the case. 7. Accordingly, the BLAPL stands disposed of. 8. Issue urgent certified copy of the order as per Rules. (G. Satapathy)
