The instant CRMP under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed for the following prayer:- “It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to: (i) Quash and set aside the impugned order dated 03.03.2022 passed by the Learned Judicial Magistrate First Class, Raipur (Chhattisgarh) in Crime No. 10/2022 registered at Mahila Thana, Raipur, whereby the Ld. Magistrate has been pleased to take cognizance under Sections 498A, 34, 294 and of the Indian Penal Code, 1860, against the present petitioners, as the same is ex-facie illegal, perverse and passed without application of judicial mind; (ii) Further be pleased to quash and set aside the entire charge sheet filed by the Police Station Mahila Thana, Raipur, in FIR No. 10/2022, against the petitioners under Sections 498A, 34, 294 and 406 IPC, being manifestly false, vexatious, malicious, and an abuse of the process of law; (iii) Further be pleased to quash the entire criminal proceedings arising out of the said charge sheet including Criminal Case No. 1750/2022, titled "State of Chhattisgarh vs. Deepak Bahrus and Others", which is presently pending before the Hon'ble Judicial Magistrate First Class, Raipur (District Raipur), as the same is wholly untenable in law, based on frivolous allegations, and continuation thereof would amount to grave miscarriage of justice; 3 (iv) Pass such other and further orders as may be deemed just, fit, proper and expedient in the facts and circumstances of the present case, in the interest of justice.. ” 2. This Court, vide its order dated 19/08/2025, after considering the possibility of compromise, directed the parties to appear before the Mediation Centre, subject to payment of Rs. 50,000/- to Respondent No. 2 by the applicants, and further directed that the matter be listed before this Court along with the mediation report, if any final settlement was arrived at. The mediation report dated 15/09/2025 has since been filed before this Court wherein it has been reported that the matter is settled. 3. Learned counsel for the applicant as well as for Respondent No. 2 have submitted that the mediation has been successful. 4. Having considered the submissions of both parties and taking into account the settlement arrived at, this Court deems it appropriate to quash and set aside the impugned order dated 03.03.2022 passed by the Judicial Magistrate First Class, Raipur, as well as the charge sheet filed in Crime No. 10/2022 at Police Station–Mahila Thana, Raipur, together with the consequential proceedings in Criminal Case No. 1750/2022 (State of Chhattisgarh vs. Deepak Bahrus and Others), pending before the said Court, subject to due fulfillment of the terms and conditions contained in the mediation report dated 15.09.2025. 5.
