By way of instant application, prayer has been made by the applicant for extension of time to comply with order dated 19.12.2024 passed by this Court in CWP No. 15753 of 2024, whereby a direction was issued to the applicant/petitioner to deposit sum of Rs. 10.00 lakh on or before 21.12.2024 and remaining amount within a week thereafter. It is averred in the application that on account of financial constraints, applicant has been able to deposit sum of Rs. 7.00 lakh only. Though having taken note of the fact that this Court had entertained the petition, which was otherwise not maintainable, on the undertaking given by the learned counsel for the petitioner that in any eventuality, sum of Rs. 10,00,000/- shall be deposited on or before 21.12.2024 and balance amount within one week thereafter, there appears to be no justification to consider payer made in the application, but by way of indulgence and as a last opportunity, further two weeks’ time is granted to the applicant/petitioner to comply with order dated 19.12.2024, failing which no prayer for extension of time shall be entertained on behalf of the applicant/petitioner and respondent Bank would be at liberty to initiate appropriate proceedings for recovery.
