This Acquittal Appeal has been preferred under Section 413 of the BNSS, 2023 against the judgment dated 24.01.2025 passed by the Judicial Magistrate First Class, Raipur in Criminal Case No.2338/2019, whereby, the respondents/accused have been acquitted of the charges under Section 406 and 498-A read with Section 34 of the IPC. 2. At the outset, learned counsel for the appellant submits that this Appeal has wrongly been filed directly before this Court, though as per the proviso of Section 413 of the BNSS, the Appeal shall lie to the Court to which an Appeal ordinarily lies against the order of conviction of such Court, therefore, he prays to withdraw this Appeal with liberty to file an Appeal before the concerned Sessions Court. 3. In view of the aforesaid, this Appeal stands dismissed as withdrawn reserving the liberty as prayed for. 4.
