Learned counsel for the petitioner would submit that Judicial Magistrate First Class dismissed the complaint vide order dated 06.01.2023, against which, petitioner filed Criminal Revision Case No.H-21/2024 before Sessions Court. However, First Additional Sessions Judge, Mahasamund 5 affirmed the order dated 06.01.2023, as the criminal case was not registered and the trial did not commence. He further submits that he has wrongly filed this acquittal appeal, as Registry has reported that this acquittal appeal is not maintainable. Therefore, he may be permitted to withdraw this petition with liberty to file appropriate application, in accordance with law. 2. Learned counsel for the respondent would not oppose the aforesaid submission. 3. In view of the above, this Petition is disposed of as withdrawn reserving liberty as aforesaid. 4.
