The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Special Case No. 3401 of 2025, arising out of Case Crime No. 475 of 2025, under Sections 352, 108, 62, 75, 351(2) of B.N.S. and Section 9f/10 POCSO Act and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015 against applicant no. 1 and under Sections 352, 351(2) of B.N.S. and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015 against applicant no. 2, Police Station- Khair, District- Aligarh, as well as cognizance/ summoning order dated 03.10.2025 pending in the Court of Special Judge (POCSO Act)/ Additional Sessions Judge, Aligarh. After some arguments, learned Senior Counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.
