THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S SUNIL DUTT YADAV - 3 - HC-KAR NC: 2025:KHC:22130 WP No. 17648 of 2025 ORAL ORDER The petitioner has sought for issuance of writ of mandamus to direct the respondents not to insist the petitioner - Association to obtain any license to carry on lawful activities like playing skill games such as Chess, snooker, carom, badminton, volley ball, table tennis, rummy and outdoor games like cricket, Kabbaddi etc. in the premises of the petitioner either under the licensing and controlling of places of public amusement order or under the Karnataka Police Act and not to interfere with the recreational and other lawful activities carried on in the petitioner - Association. 2. It is settled position in law that once the activities of Members of petitioner Association are being carried on lawfully, the question of respondent Police interfering would not arise unless the activities contravene any provisions of law. Needless to state that, it is always open to the respondent Authorities to exercise the powers vested in them, if they have information regarding - 4 - HC-KAR NC: 2025:KHC:22130 WP No. 17648 of 2025 commission of offence or violation of law. Such action of the respondent Police cannot be considered to be interference.
