The petitioner has been made accused in connection with Deoghar Cyber Crime P.S. Case No.102 of 2024 for the offences registered under Sections 318(4), 319(2), 336(3), 338, 340(2), 61 of the B.N.S., 2023 and Sections 66B, 66C, 66D and 84(C) of the I.T. Act, pending in the Court of learned Additional Sessions Judge-II-cum-Special Judge Cyber Crime Cases, Deoghar. On 24.09.2024, Cyber Police, Deoghar on the basis of confidential information that cyber criminals have assembled at Dakay forest, raided the place of occurrence and apprehended this petitioner along with co-accused persons. On search, mobile phone is alleged to has been recovered from his possession. There were several complaints with regard to the mobile phone recovered from his possession used in cheating the victim on NCRP portal. Mr. Mahesh Tewari, learned counsel for the petitioner submitted that petitioner is in custody for about 4 ½ months. It was further submitted that there is no criminal antecedent against the petitioner. Mr. Shailendra Kr. Tiwari, learned Spl.P.P. submitted that from the perusal of case diary, it appears that one Amirul Islam has made a complaint against the bearer of mobile No.9699773636 which was used in cheating him. Considering the fact that victim has turned up and claimed that the petitioner has cheated him, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
