Heard learned counsel for the petitioners and learned A.P.P. appearing for the State.
2.
This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been preferred by the petitioners apprehending their arrest in connection with Hunterganj Police Station Case No. 209 of 2022, registered for offences alleged under Sections 272, 273, 284, 290, 414, 420, 465 & 34 of the Indian Penal Code and section 47(a) of the Excise Act, pending before the Court of the Judicial Magistrate First Class, Chatra.
3.
As per the First Information Report, it has been alleged that a raid was conducted wherein several litres of Mahuwa Liquor and Jawa Mahuwa were recovered and destroyed. It has been further alleged that the miscreants fled from the place of occurrence on seeing the police party. These liquor were then taken on stolen motocycles having fake number plates to the State of Bihar for selling.
4.
Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the present case due to village politics and suspicion. There is no evidence of the petitioners being indulged in making or selling of Mahuwa Liquor or their presence at the place of occurrence.
5.
Learned APP appearing for the State has vehemently opposed the prayer of the petitioners for grant of anticipatory bail and submits that the amount of Mahuwa Liquor produced was huge in quantity. The petitioners were successful in running away when the police party reached the place of occurrence.

From the allegations in the First Information Report, I find that there is direct allegation against the petitioners indicating their involvement in the commission of the offence. Considering the specific allegations and materials against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. The prayer for grant of anticipatory bail of the petitioners is hereby rejected.
