The Court Made the Following Order: The instant petition under Section 528 of the BNSS has been filed by the Petitioner herein, against the order dated 17.04.2025 in C.C.No.2956 of 2019 on the file of the learned I Additional Judicial Magistrate of First Class, Rajamahendravaram. 2. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor for the respondent No.2/State. Perused the record. 3. Learned counsel for the petitioner submits that the Trial Court issued a non-bailable warrant as the petitioner was unable to appear on 2 the date of adjournment, she being in Canada at that time. It is further submitted that the petitioner is ready and willing to appear before the Trial Court, and in the meantime, prays for protection from arrest in connection with the said warrant. 4. As seen from the record, though the petitioner was aware that the case was posted for pronouncement of judgment, the petitioner failed to appear and the petition filed by her was dismissed. On that day, the trial Court pronounced the judgment, and consequently, a non-bailable warrant was issued against her. In the said facts and circumstances, this Court does not find any fault in issuance of NBW by the trial Court. 5. In that view, the criminal petition is disposed of, without causing any prejudice to the rights and contentions of the petitioner.
