Petitioner has invoked Section 483 BNSS for his enlargement on bail in case FIR No. 04/2023, registered with Police Station, Anti-Narcotics Task Force (ANTF), Jammu, for offences under Sections 8/21/22/29 NDPS Act, after a similar plea came to be rejected by learned Special Judge (NDPS) cases, Jammu. 02. Background facts of the case are that on 12.06.2023, aninformation came to be received by the Police Station from reliable sources that Narco smugglers and distributors namely Vishal and Geeta Devi, in possession of heroin like substance, were present near Rajiv Nagar Chowk, Jammu. On the receipt of this information, police agency swung into action. FIR came to be registered and said Vishal and Geeta Devi Sr. No. 05

were nabbed from Rajiv Nagar Narwal, Jammu and 34 gms. of heroin came to be recovered from their conscious possession. 03. According to the investigating agency, name of the applicant surfaced during investigation on the disclosure of accused Vishal and he came to be arrested from Central Jail, Ferozepur, Punjab, where he had been lodged in FIR No. 87/2025, registered with Police Station, Kulgari. As per the investigating agency, applicant in his statement under Section 67 NDPS Act admitted that 34 gms. of heroin, which was recovered from the conscious possession of co-accused Vishal and Geeta was supplied by him. 04. It is evident from the status of the investigation that an intermediate quantity of contraband came to be recovered from the conscious possession of co-accused Vishal and Geeta Devi. Applicant has been involved in the present case on the basis of disclosure statement of co- accused Vishal in the police custody and statement of the applicant recorded during investigation under Section 67 NDPS, while he was also in custody of the police. Applicant is behind the bars since 11.07.2025 in a case where nothing has been recovered from his conscious possession. Both the co-accused Vishal and Geeta Devi, from whose conscious possession intermediate quantity of heroin came to be recovered have since been enlarged on bail by the trial Court. In the circumstances, further incarceration of the applicant shall not serve any purpose of the prosecution. 3 Bail App No. 349/2025
05. Hence, present application is allowed and applicant is directed to be released on bail on his furnishing a surety bond to the tune of Rs.
25000/-, to the satisfaction of learned trial Court and a bond of personal re-cognizance of the like amount to the satisfaction of Superintendent of the concerned jail, subject, however to the condition that he shall remain present during the trial, without fail. 06. Disposed of. (Rajesh Sekhri)
