This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No.7/2025 registered at Police Station Surajpur (CG) for the offences under Sections 296, 351(3), 115(2), 109(1), 103(1), 191(2), 191(3) of the of BNSS 2023,
2. The prosecution case is that on 01.01.2025, the applicant along with other co-accused is alleged to have assaulted deceased Vijay A ANNAJEE RAO Digitally signed by A ANNAJEE RAO Date: 2025.07.23 11:14:19 +0530
2 Pratap Singh by hands and fists and sticks, as a result of which, he sustained grievous injuries and died during treatment in hospital. On report being lodged, offence under the aforesaid sections have been registered against the applicant.

Learned counsel for the applicant submits that the name of the applicant is neither mentioned in the FIR and nor any seizure was made from him. He submits that the deceased himself fell from his motorcycle in an inebriated state and sustained grievous injuries which led to his death and the applicant has been falsely implicated in this case. He further submits that the applicant is in jail since 19.03.2025 and there is no immediate possibility of disposal of the case, therefore, he may be enlarged on bail.

Per contra, learned State Counsel opposes the bail application and submits that there is eye-witness to the incident namely Ramkripal and the identification of applicant was captured in CCTV footage which shows that the deceased was assaulted by hands and fists. He further submits that the bail application of similarly placed accused Ajay Prajapati has been rejected by this Court in M.Cr.C.No. 3681 of 2025 on 10.06.2025, therefore, this bail application of the present applicant may also be rejected.
5. Having considered the submissions made by learned counsel for the parties and the fact that the trial has not yet commenced, I am not inclined to release him on regular bail at this stage. Accordingly, the bail application is rejected.
