It is the case of the petitioner that he was issued a license to run a café and restaurant, namely, the Playboy Hukka Café And Restaurant (“the Café”) in Haldwani, District Nainital by the respondent no.2, the Municipal Corporation, Haldwani. On 24.12.2022, a raid was conducted and the Café including Hukka was taken into custody. The petitioner seeks release of those articles. Heard learned counsel parties and perused the record. Learned counsel for the petitioner would submit that the respondent no. 2 did not have any lawful authority to seize Hukka from the Café. The petitioner moved a representation, but it has yet not been decided. Learned counsel for the petitioner seeks liberty to file a fresh representation, with the direction to decide it within a stipulated time, in accordance with law. Learned counsel for the respondent no.2 would submit that if a representation is given by the petitioner, it shall be decided within a period of three weeks. The Court takes on record the statement given by learned counsel for the respondent no.2. The writ petition is disposed of with the liberty to the petitioner to give a representation to the respondent no.2 within a period of one week from today. In case, such a representation is filed by the petitioner, it shall be decided by the respondent no.2 within next three weeks, in accordance with law, after affording an opportunity of hearing to the petitioner.
