JUSTICE PRAVEER BHATNAGAR
Order 17/03/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 158/2024 registered at Police Station Mehandipur-Balaji, District Dausa for the offence(s) under Sections 103(1) and 238(a) of BNS.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that entire case rests upon the circumstantial evidence, the petitioner has not caused murder of the deceased. It is alleged against the petitioner that he in connivance with the other co-accused Rajendra Meena and Chhotelal Meena after causing murder of the deceased threw the body at some other place. The direct allegation of causing murder of the deceased is shown against other co-accused Rajendra. It is also contended that
[2025:RJ-JP:11863] (2 of 3) [CRLMB-378/2025] deceased was totally unknown to the accused-petitioner. As per the prosecution story deceased entered into the house of Rajendra and Chhotelal afterwards co-accused Rajendra and Chhotelal caused beating to the deceased which resulted into his death. It is also contended that main witness Vandana has turned hostile and not supported the prosecution story. Extra judicial confession made by the other witness Chhuttan Lal is with regard to other co-accused Rajendra and not to the present petitioner. No incriminating material was recovered at the instance of the accused-petitioner. The accused-petitioner is in custody since 06.09.2024 and the trial of the case will take considerable time. Therefore, the benefit of bail may be granted to the accused- petitioner. 3. Per contra, learned Public Prosecutor opposes the bail application. Investigating officer is present before the court and submitted that the main allegation of causing murder of the deceased is against other co-accused Rajendra and Chhote Lal. 4. Heard and perused the charge-sheet and material available on the record. 5. Considering the fact that the main allegation of causing murder of the deceased is against other co-accused and petitioner has been involved in the case solely on the ground that he aided the other co-accused to screen the crime, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Ramavtar S/o Dallaram, in connection with FIR No. 158/2024 registered at Police
[2025:RJ-JP:11863] (3 of 3) [CRLMB-378/2025] Station Mehandipur-Balaji, District Dausa shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
