GP FOR REVENUE 2 The Court made the following ORAL ORDER: Heard Sri N. Ranga Reddy, learned Counsel for the Writ Petitioner and Sri Arjun Chowdary, learned Asst. Government Pleader for the Revenue. 2. It is the submission of the learned Counsel for the Writ Petitioner that only Form-I Notice has been issued to him, whereas, the Form-II Notice has not been issued to him. He would submit that it is a settled law that the Official Respondents have to serve Form-I and Form-II Notices to all the parties. 3. Learned Asst. Government Pleader has submitted the Written Instructions furnished by the Tahsildar, Lepakshi Mandal (Respondent No.4). Copy of it has been served on the learned Counsel for the Writ Petitioner and the same is taken on record. 4. The Written Instruction would indicate that the Form-I and Form-II Notices were served on the legal heirs of Assignee and the purchaser on 28.12.2024. This fact is seriously disputed by the Writ Petitioner. The Written Instructions also does not disclose whether there is availability of proof of service of these two Notices on the Writ Petitioner or not. In any case, in order to cut down the controversy, there shall be a direction to the Official Respondents to serve the copies of the Form-I and Form-II Notices to the Writ Petitioner forthwith and grant reasonable time for the Writ Petitioner to submit his explanation. The Writ Petitioner is directed to approach the Office of the Tahsildar, Lekpakhi Mandal (Respondent No.4) within two weeks from today for receiving the copies of the fresh Form-I and Form-II Notices under the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977. The Official Respondent No.4 is directed to act in accordance with law after receiving the Explanation from the Writ Petitioner. 5. Learned Counsel for the Writ Petitioner has drawn the attention to the Photographs (Ex.P.9). He would submit that Papaya standing crop is 3 there on the land and that the Writ Petitioner may not be dispossessed or interfered with. 6. Having regard to the above submission, there shall be a direction to the Official Respondents not to cause any interference or obstruction to the Writ Petitioner and his men in carrying on the agricultural operations till the Papaya crop is completely harvested. This order shall continue not withstanding any Final Order that may be passed in the Proceedings initiated under the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977. 7. With these observations and directions, this Writ Petition stands disposed of. 8. Interlocutory Applications, if any, stand closed in terms of this order. ______________________________________ GANNAMANENI RAMAKRISHNA PRASAD, J Dt: 08.01.2025 Mnr 4 112 HON'BLE SRI JUSTICE GANNAMANENI RAMAKRISHNA PRASAD WRIT PETITION No.517 OF 2025 Dt: 08.01.2025 Mnr
