THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE E.S.INDIRESH ORAL ORDER In this writ petition, petitioner is assailing the order dated 16.06.2023 (Annexure-A) passed by respondent No.3.
2. It is contended by Sri. Vardhaman V. Gunjal, learned counsel appearing for the petitioner by referring to paragraph No.11 in the writ petition and submitted that, fair opportunity has not been extended to the petitioner herein and therefore, sought for interference by this Court.
3. Per contra, learned HCGP appearing for respondent Nos.2 to 4 invited the attention of the Court to the impugned order at Annexure-A and submitted that respondent No.3 has remitted the matter to respondent

HC-KAR NC: 2025:KHC:20436 WP No. 16715 of 2023 Nos.2 and 4 and in that view of the matter, no interference is called for in this petition.
4. Sri B. Ropesha, learned counsel appearing for respondent No.1 argued on similar lines.
5. In the light of submission made by learned counsel appearing for the parties, though
learned counsel appearing for the petitioner has contended that, fair opportunity has not been extended to the petitioner, however, taking into consideration that respondent No.3 vide order dated 16.06.2023 remitted the matter to respondent No.2 and 4 to take decision in the matter afresh after affording an opportunity of hearing to all the parties concerned as well as in the civil proceedings, if any, between the parties, and in that view of the matter, I do not find any merit in this petition.
6. Accordingly writ petition is dismissed. It is also made clear that this Court is having limited jurisdiction under Article 226 and 227 of the Constitution of India, to

HC-KAR NC: 2025:KHC:20436 WP No. 16715 of 2023 interfere with the remand order passed by quasi-judicial authority. Therefore, I do not find acceptable ground to interfere with the impugned order.
