Order on Board 22.04.2025 1) The petitioner has filed this petition seeking the following relief(s):-
“10.1) That the Hon'ble Court may kindly be pleased to call for the entire records of Civil Suit No. 184A/2017 (Annexure P- 1) for the kind perusal of this Hon'ble Court. 10.2) That, it is prayed that this Hon'ble Court may be pleased to allow this petition and set aside the
order dated 15.05.2019 passed by the Learned Civil Judge Class II, Surajpur in Civil Suit Number 184A of 2017 (Mohar Lal Sahu versus Ramjatan Sahu and another), in the interest of justice. 10.3)Any other relief which this Hon'ble Court deems fit and proper may also kindly be granted to the Petitioner, in the interest of justice.” 2) In the present case, the suit was filed by the petitioner seeking a declaration of title and permanent injunction in respect of land bearing Survey No. 1460/2, admeasuring 0.12 hectare, situated at Village Joor, Patwari Circle No. 9, Bhaiyathan, District Surajpur. Respondents No. 3 and 4/defendants No. 3 and 4 filed an application under Order I Rule 10 of the Code of Civil Procedure seeking permission to implead Daulat Ram as a party defendant, on the ground that the property was initially recorded in his name and he is the predecessor-in-interest of defendants No. 3 and 4. The said application was allowed by the learned trial Court vide order dated 15.05.2019. 3) It appears that no interim relief was granted in favour of the petitioner, and
