Pursuant to the filing of the affidavit, learned counsel for the petitioner came to be aware that the writ petitioner earlier approached this Court which came to be closed in terms of the order dated 10.12.2025 passed in WP(C) No.3114/2025. Learned counsel for the petitioner submits that this instructions was not furnished to him and therefore, he was unaware that the petitioner had earlier approached this Court which came to be closed by order dated 10.12.2025 passed in WP(C) No.3114/2025. Under such circumstances, he has made his prayer seeking withdrawal of the writ petition. He further submits that in the earlier writ petition different set of counsel was representing the writ petitioner. 3. Ms. M Bhattacharjee, learned Additional Senior Government Advocate, Assam submits that in spite of the writ petitioner having approached this Court Page No.# 3/4 by filling in WP(C) No.3114/2025 and which came to be dismissed by order dated 10.12.2025, the writ petition has been filed suppressing this fact and therefore, the writ petition should be dismissed imposing cost on the petitioner. 4. Mr. MK Borah, learned counsel appearing on behalf of Mr. JK Goswami, learned Standing Counsel, Animal, Husbandry and Veterinary Department for the respondents no. 2 & 4 submits that an affidavit has been filed today. 5. Be that as it may, in view of the order dated 10.12.2025 passed in WP(C) No.3114/2025, the writ petition stands dismissed as the petitioner has willfully and deliberately suppressed the fact that the earlier writ petition on the same cause was filed and was rejected by order dated 10.12.2025 passed in WP(C) No.3114/2025. 6. Accordingly, the prayer for withdrawal of the writ petition is rejected. The writ petition stands dismissed on the ground suppression. A cost of Rs.3,000/- (Rupees Three Thousand only) is imposed on the petitioner, which the petitioner shall deposit before the High Court Legal Aid Services Committee within a period of 2 (two) months from the date of receipt of a certified copy of this order. 7. A copy of this order be marked to the Member Secretary of the High Court Legal Aid Service Committee and if the amount is not deposited within a period of 2 (two) months, the same shall be brought to the notice of the Court.
