--------- 09/Dated: 03.04.2025 1) The petitioners in both these cases had been granted mining leases on 29.03.2016. 2) The Deputy Commissioner and District Magistrate, Chatra on 01.02.2021 pre maturely cancelled the said leases invoking power under section 27(2) of the Jharkhand Minor Minerals Concession Rules, 2004. 3) Challenging the same, the petitioners filed the revision before the Mines Commissioner, Ranchi, Jharkhand. 4) The same was also rejected on 28.03.2023 by the Mines Commissioner and the same was communicated on 17.07.2023 under the signature of the Under Secretary, Department of Mines and Geology, Government of Jharkhand.

5) Counsel for the petitioners placed reliance on the judgment dt. 06.02.2025 in W.P.(C) No. 88 of 2024 in which it was held that the Deputy Commissioner has no power to cancel mining lease granted to a lessee at a premature stage unless and until there is a violation of the terms and conditions of the mining leases. 6) It was held therein that under section 4A(2) of the Mines and Minerals (Development and Regulation) Act, 1957 only the State Government is vested with the power to cancel the mining lease at a pre-mature stage when it is in public interest. 7) Rule 27(1) of the Jharkhand Minor Minerals Concession Rules, 2004 also reiterates the same legal position. 8) Counsel for the respondents does not dispute this legal position. 9) Therefore, these writ petitions are allowed and the orders dt. 01.02.2021 of the Deputy Commissioner, Chatra as well as the
order dt. 28.03.2023 of the Mines Commissioner, Ranchi in the revisions preferred by the respective petitioners against the
order of the Deputy Commissioner are both set aside by following the judgment dt. 06.02.2025 in W.P. (C) No. 88 of
2024. 10) Liberty is granted to the competent authority to take action in accordance with law against the respective petitioners, if they are so advised.
