THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner has sought for the following relief:- “Wherefore, it is humbly prayed that this Hon’ble Court be pleased to quash the charge sheet in C.C.No.7685/2024 on the file of VII Additional Chief Metropolitan Magistrate at Bengaluru based on the complaint filed by the respondent No.2 against the petitioner for the offence punishable under Section 417, 419 of IPC in so far as petitioner is concerned in the interest of justice.” 2. Learned counsel for the petitioner – accused and learned counsel for 2nd respondent – complainant have filed a Joint Compromise Petition duly signed by the petitioner, 2nd respondent and their respective counsel and the same is taken on record. - 3 - NC: 2025:KHC:7754 CRL.P No. 8706 of 2024 3. Petitioner – accused, respondent No.2 and their counsel are physically present before the Court and they admit the contents of the Joint Compromise Petition, which reads as under:- “JOINT COMPROMISE PETITION It is respectfully submitted as follows:- 1. That the petitioner herein is the accused in C.C. No. 7685 of 2024 registered by Vidyaranyapura police station pending on the file of VII Addl. Chief Metropolitan Magistrate, Bangalore, initiated as against the petitioner based on the complaint filed by respondent No.2 for offences punishable under section 417, 419 of I.P.C. That the accused in the above case and the complainant have compromised and settled the above matter out of the court due to the intervention of the relatives, well-wishers and friends of both the parties and thus the complainant/respondent No. 2 do not wish to continue with the above case as against the petitioner in the above criminal petition. 2. It is submitted that the petitioner and complainant/Respondent No. 2 have compromised and settled the above case out of court and they have got no claim as against each other and also both the parties shall have no right to institute any proceedings/case before the court of law as against each other. Hence, it is humbly prayed that, this Hon'ble court may be pleased to permit the above named petitioner and - 4 - NC: 2025:KHC:7754 CRL.P No. 8706 of 2024 the respondent No. 2/Complainant to compound and compromise the above case in the interest or justice.” 4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Compromise Petition dated 18.02.2025. (ii) The proceedings in C.C.No.7685/2024 (arising out of Crime No.474/2023 of 1st respondent – Police) registered for the offences punishable under Sections 417 and 419 of IPC pending on the file of VII Additional Chief Metropolitan Magistrate, Bengaluru, insofar as the petitioner is concerned are hereby quashed.
