This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A6, seeking regular bail, in Crime No.406 of 2024 of pM Palem Police Station, Visakhapatnam CommissiOnerate. 2. A case has been registered against the Petitioner herein and others for the offences punishable under Sections 20(b)(ii) . t=-iL T--i.', , +.- .,--..4 2 I, and 27(b) of the Narcotic Drugs and Psychotropic Substances Act,1985 (for short lthe NDPS Act'), 3. Case of the prosecution, in brief, is that, on 13.07.2024, at about ll.00 hours, on receipt of credible information, the Sub- lnspector of Police, PM Palem Police Station, Visakhapatnam City, along with his staff and mediators, rushed to bushes situated on the back side of Narayana IIT Academy, Thimmapuram Road, Marikivalasa, Visakhapatnam city and found A3 to A5 in possession ofGanja paper rolls. A3 toA5 confessed that they purchased the said Ganja from Al and A2. Then the police conducted raid at Goat kabela, Marikavalasa and found Al and A2 in possession of 1300 Grams and 1100 Grams of Ganja. Al and A2 confessed that they purchased 3 Kgs of Ganja from A6. Subsequently, A6 was arrested while he was in possession of 6.070 Kgs of Ganja. The contraband was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. Petitioner herein was arrested on 21.10.2024 and since then he is in judicial remand. The quantity of Ganja allegedly se-lzed from the possession of the petitioner herein/A6 is 6.070 \=--\_i 3 r/ Kgs, Which iS not a COmmerC-lal quantity. Learned Ass-lstant publ-lc prosecutor submitted that major portion of investigation has been completed and there are no antecedents against the petitioner herein. 6. ln View Of the aforesaid facts and Circumstances Of the case, this court is inclined to grant bail to the petitioner/A6 on the following conditions. i) The petitioner/A6 shall be released On ba" On his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand Only) With two Sureties Of the like Sum each tO the satisfaction of the learned xvl Addit-lonal Metropolitan Mag-IStrate, BhimuniPatnam.
