W.P.No.16738/2023 is filed by petitioners-defendant Nos.1 and 2 and W.P.No.9641/2023 is filed by the petitioners, who are the LRs. of plaintiff-Srinivasa under Article 227 of the Constitution of India challenging the order dated 21.02.2023 passed by the Additional Civil Judge and JMFC, Devanahalli on I.A.No.6 in - 5 - NC: 2025:KHC:5835 WP No. 16738 of 2023 C/W WP No. 9641 of 2023 O.S.No.554/2016, whereby the trial Court has partly allowed the said application. 2. The plaintiffs filed the suit for specific performance of contract on 08.08.2013. During the pendency of the suit, the suit schedule property has been acquired by the Karnataka Industrial Areas Development Board (KIADB) for formation of industrial estate. The compensation determined by the KIADB is at Rs.1,29,25,000/-. Before the LRs. of plaintiff filed an application under Section 151 of CPC, defendant No.1 has withdrawn Rs.99,25,000/-. Therefore, LRs. of plaintiff has filed I.A.No.6 under Section 151 of CPC. The trial Court by impugned order dated 21.02.2023 directed the KIADB to deposit remaining amount of Rs.30,00,000/- before the trial Court and also directed defendant Nos.1 and 2 to execute the indemnity bond in respect of Rs.99,25,000/- indemnifying to the Court that in the event, the legal representatives of plaintiff succeeds in the suit, they will pay Rs.99,25,000/- - 6 - NC: 2025:KHC:5835 WP No. 16738 of 2023 C/W WP No. 9641 of 2023 to the legal representatives of plaintiff. Being aggrieved, the present petition is filed. 3. In view of the above, considering the dispute in the suit, I am of the opinion that the trial Court was justified in passing such an order. There is no error or illegality in the order passed by the trial Court. 4. Accordingly, the writ petitions are dismissed. 5. The Additional Civil Judge and JMFC, Devanahalli is directed to dispose of the suit as expeditiously as possible, not later than one year from the date of receipt of certified copy of this order. 6.
