This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“...to pleased issue writ, order, direction, more particularly in the nature of writ of mandamus declaring the action of Respondent No.3 and 4 in summoning and threatening the petitioner on the behest of respondent no.5 as highhanded, illegal, arbitrary and violation of article 14, 21 of constitution of india and consequently direct the respondent No.3 and 4 to not to summon and harass the petitioner and to pass..”
02. When the matter is taken up for hearing, Sri Md.Farooq, learned Assistant Government Pleader for Home, on instructions, would submit that a crime has been registered against the petitioner in Cr.No.187 of 2025 under Sections 127 (2), 146 r/w 3(5) BNS, 16 BLSA of Tangutur PS on 04.08.2025.
It is further submitted that during the course of investigation, the petitioner was never called to the Police Station. Having came to know about the registration of the case against him in the respondent Police Station, the petitioner filed the present writ petition seeking to stall the investigation and evade due process. It is also submitted that the investigation is still in progress and no coercive steps have been taken so far. 3. Sri P.Kasi Nageswara Rao, learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 4
4. Recording the same, the Writ Petition is disposed of. However, the Police are directed to follow the due process of law. No order as to costs.
