The present Writ Petition is filed to declare the action of the Respondent No.2 in resorting to construct the Water Plant in Sy.No.186/1 & 2 of Banaganapalli Village & Mandal, Kurnool District, which is earmarked and being used as burial ground and further action of the Respondent Nos.3 & 4 in not taking any action to protect the said burial ground, as illegal and arbitrary and to pass such other orders. 2. As per the averments made in the Writ Affidavit, the subject matter property was the Wakf property meant for Muslim burial ground, in which the Respondent No.2 is resorting to construct a Water Plant and the Respondent Nos.3 & 4 are not taking any action to protect the burial ground. Hence, the present Writ Petition is filed. 3. No Counter Affidavit is filed by the Respondents. 4. This Court on 23.12.2013 passed an interim order restraining the Respondent No.2 from making construction for establishing the Reverse Osmosis Water Treatment Plant in the Muslim burial ground, which is a Wakf property. 5. At the time of hearing, M/s. K. Rathanga Pani Reddy, learned counsel for the Petitioner submits that the cause in this Writ Petition does not survive since there is no proposal as on date for construction of any Water Treat Plant in the Muslim burial ground. 6. In view of the submissions made by the learned counsel for the Petitioner that the Writ Petition is closed. There shall be no order as to costs.
