2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 21116/2023 The present Writ Petition is filed questioning the transfer of the Petitioner from Government Junior College for Boys Jammalamadugu to Government Junior College, Proddutur, YSR District, contrary to the transfer guidelines as applicable in the year 2023. 2. The Petitioner was initially appointed as Junior Lecturer in History and thereafter his services were regularized in the cadre of Junior Lecturer. It is stated that the Petitioner had worked at various places. While so, Go.R.T.No.82, dated 23.05.2023 was issued by the Government of School Education framing certain guidelines for transfer of the employees. The Petitioner had opted Government Junior College for Girls, Kadapa, as a first preference. Government Junior College, Proddutur, as a second preference and Government Junior College, Pendlimarri as a third preference. Even though a clear vacancy is available at Junior College for Girls at Kadapa, the Petitioner was posted at Government Junior College, Proddutur, i.e., the second preference of the Petitioner. 3 As the Petitioner was given second preference of posting, a representation dated 25.07.2023 was given by the Petitioner to post him at the Junior College for girls, Kadapa, as he underwent Neuro Surgery and also suffering with backbone problem. As the representation of the Petitioner was not being considered, the present Writ Petition is filed. 3.
4 Learned Assistant Government Pleader submits that the Government employee cannot choose a specific place of posting and it is at best left to the administration to decide this particular aspect. It is further submitted that the Petitioner was posted at a place of his second preference and as such, the Petitioner cannot have any grievance now. 5. Having heard the respective counsel, this Court is of the opinion that it would not be appropriate for this Court to decide the place of posting as it is the administrative discretion which cannot be interdicted by this Court. However, taking into consideration the medical condition of the Petitioner, the Respondents are directed to consider the representation of the Petitioner dated 25.07.2003 for posting at Government Junior College for Girls, Kadapa, as expeditiously as possible. 4
6. Accordingly, the Writ Petition is disposed of. There shall be
order as to costs. no As a sequel, miscellaneous petitions, pending if any, shall stand closed.
