Aggrieved by the notice dated 22.07.2025 issued by the Municipal Board Ramganj Mandi, District Kota (for short, “the Board”), the instant writ petition has been preferred. 2. By issuing the notice dated 22.07.2024 under Section 194 of the Rajasthan Municipalities Act, 2009 (for short, “the Act of 2009”), it has been alleged by the Board against the petitioners [2025:RJ-JP:37164] (2 of 2) [CW-13639/2025] that he has raised certain constructions without seeking permission and these constructions raised by the petitioners have been treated as unauthorized and the same has been done without leaving proper set-back. 3. Reply to the aforesaid impugned notice has already been submitted by the petitioners, wherein it has been stated that no unauthorized construction has been raised by the petitioners and proper set-back has been left on the subject land. 4. This Court is not going into the controversy involved in this writ petition as to whether a notice was rightly issued or not; whether the petitioners have raised any unauthorized constructions on the subject land or not; whether proper set-back has been left or not; it is for the authorities concerned to look into the matter on the basis of the reply submitted by the petitioners. 5. This Court deems it just and proper to dispose of the instant writ petition with direction to the Board to decide the reply submitted by the petitioners, by passing a reasoned and speaking order within a period of three weeks from the date of receipt of certified copy of this order. 6. Needless to observe, in case, any adverse order is passed against the petitioners, they would be at liberty to approach the appropriate form of law for redressal of their grievances. 7. Stay application and all pending application(s), if any, also stand disposed of. (ANOOP KUMAR DHAND),J Aayush Sharma /39
