Earlier prayer for bail of the petitioner was rejected vide order dated 23.06.2023 passed in B.A. No.2881 of 2023 and vide order dated 09.02.2024 passed in B.A. No.11407 of 2023 on merits and direction was given to the learned Trial Court to expedite the trial and conclude the same within nine months from the date of the order. Petitioner above-named who is in custody has renewed his prayer before this Court for grant of regular bail in connection with Pathalgadda P.S. Case No.57 of 2022 registered under Sections 302, 34 of the Indian Penal Code. Heard the parties. It is submitted by learned counsel for the petitioner that more than nine months have already elapsed and out of ten charge-sheeted witnesses, only five witnesses have been examined and further there is no evidence against him. Learned APP for the State has vehemently opposed the prayer. Considering the submissions of learned counsel and the fact as discussed above, the bail application is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below subject to the condition that one of the bailor(s) must be close relatives of the petitioner.
