Petitioner has been made an accused in connection with S.T. Case No. 19 of 2024, arising out of Barkagaon P.S. Case No. 91 of 2014, registered under Sections 364/34 of the Indian Penal Code, pending in the Court of learned Special Judge N.D.P.S. Act, Hazaribag.
On 10.06.2014, the informant and some members of his staff were abducted by miscreants to enforce the demand of levy.
It was submitted that the victims were released later on at Gwalior. It was further submitted that similarly situated co- accused persons have been granted Anticipatory Bail by co-ordinate bench of this court. It was further submitted that co-accused persons who had faced separate trial had been acquitted as the victims had not supported the prosecution case.
Learned A.P.P. has opposed the prayer for bail and submitted that the victim in his statement recorded under section 183 B.N.S.S. has named this petitioner.
Regard being had to the facts and circumstance of the case and considering the fact that several similarly situated co- accused persons have been granted anticipatory bail by co-ordinate bench of this court, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty
Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge N.D.P.S. Act, Hazaribag in connection with S.T. Case No. 19 of 2024, arising out of Barkagaon P.S. Case No. 91 of 2014.
