GP FOR HOME 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 21140 of 2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue an appropriate writ or order or direction more particularly a writ in the nature of a Writ of Mandamus to the action of the Respondents particularly the 2nd Respondent and 3rd Respondent in interfering in civil disputes between private persons, calling the Petitioners to police station and trying to disposes the Petitioners from their agricultural lands to an extent of Acres. 1.33Cents in Sy.No.271-2 of Kancheru Village, Bhogapuram Mandal, Vizianagaram District as illegal arbitrary and violative of article 14, 21 and 300-A of the Constitution of India and consequently direct the Respondents particularly the 2nd Respondent and 3rd Respondent not to interfere in civil disputes between private persons, not to call the Petitioners to police station and not to disposes the Petitioners from their agricultural lands to an extent of Acres. 1.33Cents in Sy.No.271-2 of Kancheru Village, Bhogapuram Mandal, Vizianagaram District and/or pass such….” 2. Heard Sri N.Bharath Simha Reddy, learned counsel for the petitioners and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioners would submit that no crime has been registered against the petitioners so far, no civil suit is pending between the petitioner and third parties. However, the police are interfering with the civil disputes between the parties and are trying to dispossess the petitioners from the subject property. 3 4. Learned Assistant Government Pleader for Home for the respondents would submit that the police are not interfering in the civil disputes between the parties, in the light of the interim Order passed by this Court vide Order dated 07.08.2025. 5. Considering the submissions made, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the petitioners and third parties, except under due process of law. There shall be no order as to costs.
