The applicant has preferred this application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 73/2025, registered at Police Station – Bhanu Pratappur, District – North Baster Kanker (C.G.) for the alleged commission of offence punishable under Section 420 of the Indian Penal Code (for short IPC). As per prosecution story and allegations the applicant has allured the complainant for doubling the money within a month or two and taken Rs. 5000/-on 9.6.2023 and Rs. 10,00,00/on 28.8.2023 in his bank account no. 918010028676556 of the Axis Bank in the name of one WFT Company. As and when the applicant had adopted dilly daly tactice for returning the com-plainant's money then she lodged the FIR bearing no. 73/2025 at police station Bhanupratappur (CG) for commission of offence U/s 420 of the IPC. In the FIR, there is inclusion of commission of cheating and inducement with other third persons thus the amount of cheating reached upto 65,18,400/-. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He also submits that FIR is lodged with delay of 459 days and no explanation has been given for this delay by the complainant. Further, the FIR has been registered under Section 420 of the IPC while it should be registered under Section 318 of BNSS because since 1.07.2024 BNSS is in force. The photo copy of the FIR regarding Crime No. 73 of 2025 is Annexed as – A. He further submits that applicant is ready to furnish adequate security & shall abide by all directions & conditions which may be imposed by this Hon’ble Court while granting of bail. Therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 3 / 3 6. Considering the nature and gravity of the offence and the material available in the case diary, and also taking into account the fact that the applicant allured the complainant with a promise to double the money within a month or two and took Rs.5,000/-, and that there is evidence of cheating and inducement involving other individuals also, with the total amount of cheating reaching Rs. 65,18,400/-, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant – Vinod Pandey , involved in Crime No. 73/2025, registered at Police Station – Bhanu Pratappur, District – North Baster Kanker (C.G.) for the alleged commission of offence punishable under Section 420 of the Indian Penal Code (for short IPC), is rejected.
