The Court made the following order:
This Contempt Case is filed under Sections 10 to 12 of Contempt of Courts Act, 1971 against the respondents for willful disobedience of the order dated 03.01.2023 passed by this Court in Writ Petition No.23230 of 2018. 2.
Sri Ch.C.Krishna Reddy, learned counsel for the petitioner filed reply stating that the petitioners are the purchasers of the subject land from the original assignees. The petitioners are entitled for compensation along with statutory benefits on par with private lands owners. 3. Sri C.Vamsi Krishna, learned counsel for respondent Nos.2 to 4, submitted that this Court vide common order dated 03.01.2023 in Writ Petition No.23230 of 2018 along with other Writ Petitions directed the respondent authorities to consider the claims of the petitioners for payment of compensation and pay compensation in terms of full Bench judgment of this Court in Land Acquisition Officer-cum-Revenue Divisional officer, Domalguda v. Mekala Pandu and others in respect of their resumed lands payable on the date of resumption, with all other benefits as per the provisions of the Land Acquisition Act, within a period of eight weeks from the date of receipt of a copy of the order, if they are found to be the original assignees and the purchasers of the assigned lands are at liberty to pursue the remedies available to them as per law. He further submitted that pursuant to the orders of this Court, notices were issued to the concerned requesting to attend the

Tahsildar Office, Chitvel for enquiry along with evidences to prove the right and title over the claimed lands. During enquiry, it is found that the subject lands, which are under the possession of the petitioners, are not assigned lands and the petitioners are not the assignees and they are enjoying the lands by way of encroachment. Accordingly, an amount of 50% of the Market Value towards exgratia was paid to the petitioners in terms of conditions prescribed in G.O.Ms.No.639, Revenue (Assn IV) Department, dated 20.09.2001 and the petitioners received the said amount.
He further submitted that even otherwise, the petitioners are not entitled to purchase the assigned land from the original assignees by virtue of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 (Act 9 of 1977), and therefore prayed to close the Contempt Case. 4. This Court directed the authorities to consider the claim of the petitioner for payment of compensation in terms of Mekala Pandu’s case, in case they are assignees. It is the contention of the respondents that the petitioners are not assignees and they are the encroachers and hence they were received benefit in terms of G.O.Ms.No.639 dated 20.09.2001. Hence, there is no disobedience as alleged by the petitioners. 5. Recording the submissions of both the learned counsel, since the petitioners are only encroachers and also they have no right to purchase the assigned lands by virtue of Act 9 of 1977, they cannot pursue the Contempt
