CRM-M-11200-2025 #1# IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH. CRM-M-11200-2025 Date of Decision:-26.08.2025 Firoz & Ors. ......Petitioner. Vs. State of Haryana & Ors. ......Respondents. CORAM:- HON'BLE MR. JUSTICE JASJIT SINGH BEDI Present:- Mr. Samay Sandhawalia, Advocate for the Petitioner. Mr. Viney Phogat, Deputy Advocate General, Haryana. Mr. Anshul Mangla, Advocate with Mr. Vikram Rathee, Advocate for respondent nos.2 & 3. *** JASJIT SINGH BEDI, J.(ORAL) The prayer in this petition under Section 528 of the BNSS, 2023 is for quashing of FIR No.193 dated 17.11.2024 under Sections 316(2), 318(4), 351(2), 303(2), 61(2) of BNS, 2023 registered at P.S. Pratap Nagar, Yamuna Nagar and all consequential proceedings arising therefrom on the basis of compromise dated 11.02.2025 (Annexure P-2) arrived at between the parties. Vide orders dated 01.03.2025 this Court had directed the parties to appear before Illaqa Magistrate for getting their statements recorded in terms of certain parameters given in the aforesaid orders dated 01.03.2025 with regard to the compromise dated 11.02.2025 (Annexure P-2). In terms of the orders dated 01.02.2025 passed by this Court parties have appeared before the court of Judicial Magistrate Ist Class, Sub Division Bilaspur and as per report dated 26.03.2025 submitted to this Court, both the parties have got recorded their respective statements in Court. VINAY MAHAJAN 2025.08.27 10:58 I attest to the accuracy and integrity of this document CRM-M-11200-2025 #2# Perusal of the aforesaid report would show that the parties have effected a genuine compromise without there being any pressure, coercion or undue influence. Further in terms of the said compromise, the counsel for the complainant admitted the fact that the complainant had received a sum of Rs.1,90,00,000/-. In view of the compromise there is a remote possibility of the complainant coming forward to support the prosecution case. The powers under Section 482 Cr.PC can be exercised in such like situation in order to prevent unnecessary vagaries of criminal trial to be faced by the parties, when there are remote chances of conviction of the accused. The compromise in question is found to be fully in consonance with the direction issued by the Court in Kulwinder Singh & Ors. Vs. State of Punjab 2007(3) RCR (Criminal) 1052 and Gian Singh Vs. State of Punjab & Anr., 2012(4) RCR (Crl.) 543. In view of the aforesaid reports of the learned Judicial Magistrate Ist Class, Sub Division Bilaspur accompanied by statements of both the parties, the FIR No.193 dated 17.11.2024 under Sections 316(2), 318(4), 351(2), 303(2), 61(2) of BNS, 2023 registered at P.S. Pratap Nagar, Yamuna Nagar and all consequential proceedings arising therefrom are hereby quashed. Petition stands disposed of.
