The petitioners has sought a direction upon respondent No. 2- Tehsildar to issue Intikhab/revenue extract regarding the land measuring 3 Kanals, 7 Marlas falling under Survey No. 1543/1472/615, situated at village Katli, Tehsil and District Samba. 2. The ground urged by the petitioner is that proprietary rights in respect of the land in question have been conferred upon predecessor-in- interest of the petitioner in terms of Government Order No. S- 432/1966. Thus, as per the law laid down by this Court in cases titled as Angrez Singh vs UT of J&K and Ors. reported in AIR 2023 J&K 533 and Mohammad Akbar Shah vs State & Ors. reported in AIR 2017 J&K 14 the said land can be alienated by the petitioner. 3. Issue notice to the respondents. Serial No. 104 2 WP(C) No. 890/2025 4. Ms. Monika Kohli, learned Senior AAG waives notice on behalf of the respondents. 5. Learned counsel for the petitioners submits that the petitioner would feel satisfied if a direction is issued to the respondents to re-consider the application of the petitioner for issuance of revenue extract in light of the ratio laid down by this Court in the aforesaid two cases. 6. In view of the above, the instant petition along with the connected applications is disposed of with a direction to respondent No. 2- Tehsildar, Samba to re-consider the case of the petitioner regarding issuance of revenue extracts in respect of the aforesaid land for the purpose of alienation in accordance with the ratio laid down by this Court in cases titled as Angrez Singh vs UT of J&K and Ors. reported in AIR 2023 J&K 533 and Mohammad Akbar Shah vs State & Ors. reported in AIR 2017 J&K 14, most expeditiously, preferably within a period of 15 days from the date a certified copy of this order is made available to the said respondent. 7.
