The petitioner has been made accused in connection with Gawan P.S. Case No. 54 of 2024, corresponding to POCSO Case No.108 of 2024, for the offences registered under Sections 376(DA)/379/506 of the Indian Penal Code and Sections 4/6/8/10 of POCSO Act, but the cognizance has been taken under Sections 376(DA)/341/379 of the Indian Penal Code and Sections 4/6/8/10 of POCSO Act, pending in the court of learned Special Judge, POCSO Act, Giridih. On 24.05.2024, petitioner alongwith co-accused persons intercepted the daughter of the informant and her relatives near Gobardaha forest area. It is alleged that petitioner caught hold the hand of the victim while another co-accused caught hold of her leg and third accused raped her. This is a case of gang rape of the daughter of the informant. Considering the aforesaid fact, I am not inclined to release the petitioner, on bail.
