Heard Mr. Diwakar Jha, learned counsel appearing for the petitioner and Mrs. Kumari Rashmi, learned A.P.P. for the State. 2. This application has been filed for restoration of A.B.A. No. 3685 of 2024 which was dismissed for default on account of non-compliance of the order dated 17.10.2024. 3. Submission has been made on behalf of petitioner that inadvertently order dated 17.10.2024 passed in A.B.A. No. 3685 of 2024 has not been complied on behalf of petitioner but it was not intentional. 4. He further buttress his argument by making submission that typed copy of the documents as pointed out by the office has already been filed on 28.10.2024 which is very evident from Annexure- 2 to the present petition. 5. From perusal of record, it transpires that vide order dated 17.10.2024 passed in A.B.A. No. 3685 of 2024, this Court has directed to remove the defect(s) within seven working days from the date of order. However, the same could not be complied on behalf of petitioner, as such, A.B.A. No. 3685 of 2024 was got dismissed. 6. Considering the fact that the documents as required, has already been filed and accordingly, the instant petition is allowed and A.B.A. No. 3685 of 2024 is, hereby, restored to its original file.
