THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioners have sought for the following reliefs:- “WHEREFORE, the Petitioner no.1 to 3 prays that this Hon'ble Court be pleased to call for entire records in C.C.No.261/2025, on the file of The XXIV Additional Chief Metropolitan Magistrate, Bengaluru and quash the Crime No.204/2021 and charge sheet, filed for an offences punishable under Section 498(A), 504 R/w 34 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act to pass any such other order/s or relief/s as this Hon'ble Court may deem fit in the facts and circumstances of the case, in the interest of justice.” 2. Learned counsel for the petitioners – accused Nos.1, 3 and 4 and learned counsel for respondent No.2 – complainant have filed a Joint Memo and accompanying affidavit, dated 26.06.2025 duly signed by the petitioners, respondent No.2 and their respective counsel and the same is taken on record. - 3 - HC-KAR NC: 2025:KHC:22572 CRL.P No. 8260 of 2025 3. Petitioners – accused Nos.1 3 and 4, respondent No.2- complainant and their respective counsel are physically present before the Court and they admit the contents of the aforesaid Joint Memo and the accompanying affidavit, which reads as under:- “JOINT MEMO The above named petitioner no.1 to 3 and the Respondent no.2 begs to submit as follows; That the petitioner no.1 is husband, petitioner no.2 and 3 are sister in law of the Respondent no.2. That at the intervention of the elders and well-wishers and entering into Memorandum of Settlement in divorce petition F.C.O.P No. 273/2021 (renumbered as F.C.O.P No. 518/2022) by the 1 petitioner and 2nd respondent, the Respondent no.2 is not interested in the matter of continuing the prosecution of C. C. No. 261/2025 (Crime No.204/2021) on the file of XXIV Addl., Chief Judicial Magistrate, at Bangalore for an offence punishable U/s 498(A), 504 R/w 34 of the Indian Penal Code and Section 3 and 4 of DP Act against the petitioner no.1 to 3 of the Vijayanagar Police Station and the Respondent no.2 filed the accompanying affidavit in respect of the same for kind perusal of this Hon'ble Court. Further, they desire to live peacefully and amicably. Wherefore, it is humbly prayed that this Hon'ble Court may be pleased to record the compromise and quash the proceedings as prayed in the petition, in the interest of justice.” - 4 - HC-KAR NC: 2025:KHC:22572 CRL.P No. 8260 of 2025 “Affidavit i, Mrs. Mannava Smitha, W/o Mannava Venkat Sharat Chandra, Aged about 45 years, Residing at No.1024, 11th Main. 5th Cross, Hampinagar. Vijayanagar 2nd Stage, Bangalore 560 0104, do hereby state on solemn affirmation on oath as follows; 1. I state that I am the 2nd Respondent in the above case and I am aware of the facts and circumstances of the case. Hence I swear to this affidavit. The contents of the accompanying Joint Memo therein be read as part and parcel of this affidavit. 2. I state that at the intervention of my elders and well-wishers and entering into Memorandum of Settlement in divorce petition F.C.O.P No. 273/2021 (renumbered as F.C.O.P No. 518/2022), I am not interested in the matter of continuing the prosecution of C. C. No. 261/2025 (Crime No.204/2021) on the file of XXIV Addl., Chief Judicial Magistrate, at Bangalore for an offence punishable U/s 498(A), 504 R/w 34 of the Indian Penal Code and Section 3 and 4 of DP Act against the petitioner no.1 to 3 of the Vijayanagar Police station against the petitioner no.1 to 3. Wherefore, I pray that this Hon'ble Court be pleased to quash the further proceedings in C. C. No. 261/2025 (Crime No.204/2021) on the file of XXIV Addl. Chief Judicial Magistrate, at Bangalore for an offence punishable U/s - 5 - HC-KAR NC: 2025:KHC:22572 CRL.P No. 8260 of 2025 498(A), 504 R/w 34 of the Indian Penal Code and Section 3 and 4 of DP Act against the petitioner no.1 to 3 of the Vijayanagar, to serve the interest of justice and equity.” 4. In view of the aforesaid settlement entered into between the petitioners-accused Nos.1, 3 and 4 and respondent No.2, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Memo and the accompanying affidavit dated 26.06.2025. (ii) The proceedings in C.C.No.261/2025 (arising out of Crime No.204/2021 of 1st respondent – Police) registered for the offences punishable under Sections 498(A), 504 R/w 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, pending on the file of the XXIV Additional Chief Metropolitan Magistrate, Bengaluru, insofar as the petitioners are concerned are hereby quashed.
